Terms of Service

These Terms of Service (“Terms”) govern your use of Divvy the Cost (“Divvy the Cost,” “we,” “us”). By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.

1. The service

Divvy the Cost is a web application that helps groups plan trips: meal planning, packing lists, shopping lists, weather aggregation, expense tracking, and pro-rata cost splitting across families. Features may change as the service evolves.

2. Your account

  • You must be at least 13 years old to create an account.
  • You are responsible for keeping your login credentials safe and for all activity that happens under your account.
  • The information you provide must be accurate. You may not impersonate another person or organization.
  • One person, one account. Do not share credentials.

3. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law.
  • Upload content that is illegal, defamatory, harassing, or that infringes someone else's rights.
  • Attempt to break the service, bypass access controls, scrape data you are not entitled to, or interfere with other users' use of the service.
  • Resell, sublicense, or commercially redistribute the service without our written permission.
  • Use automated tools (bots, scrapers, crawlers) to access the service except as expressly permitted.

We may suspend or terminate accounts that violate these rules.

4. Your content

The trip, family, expense, and other content you enter (“Your Content”) is yours. By using the service you grant us the limited permissions we need to store, display, and process Your Content for the purpose of providing the service to you and the people you share trips with. We do not claim ownership of Your Content and we do not use it to train machine-learning models.

You are responsible for ensuring you have the right to enter information about other people (for example, the names and ages of family members) into the service.

5. Plans, billing, and refunds

Divvy the Cost offers a free tier and may offer paid plans (for example, a per-trip upgrade and an annual organization plan). Pricing is shown on the website at the time of purchase. Paid plans are billed in advance for the period you select.

  • You can cancel a recurring subscription at any time; cancellation stops future renewals but does not refund the current period.
  • One-time upgrades (such as a per-trip pass) are non-refundable except where required by law.
  • If we change prices, we will notify subscribers in advance; price changes apply to the next renewal.
  • If a charge is disputed in good faith, contact us at troy@burdett.us and we will work with you in good faith.

6. Organizations and roles

Trips belong to an organization, and other people can be invited to join an organization or a specific trip. Invited members can see and modify trip data according to the role you assign (admin, author, editor, viewer, member). You are responsible for the access you grant. Removing a member ends their future access but does not retroactively change records they already saw.

7. Termination

You may stop using the service at any time. You can request account deletion as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if continuing to provide the service to you would create undue risk to other users or the service. If we terminate without cause, we will refund any unused portion of a paid subscription period.

8. Disclaimers

Divvy the Cost is provided “as is” and “as available.” We do our best to keep the service running and the math correct, but we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Cost splits, weather data, and other calculations are provided for convenience and should be reviewed by you before you rely on them.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Divvy the Cost or its operators be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the service. Our total aggregate liability for any claim arising out of or related to the service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) USD $50.

10. Indemnity

You agree to defend and indemnify Divvy the Cost and its operators against any claims, damages, and expenses arising from Your Content, your use of the service, or your violation of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the app or by email at least 14 days before they take effect for existing accounts. Continued use of Divvy the Cost after the effective date means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you have as a consumer that cannot be waived under applicable law.
